Feb. 17<\/span>The Trump Organization told the Associated Press<\/u> it didn\u2019t seek any profit but only protection against \u201cbad actors\u201d given that the Trump name is the \u201cmost infringed trademark in the world.\u201d <\/p>\n<\/div>\n

March 30<\/span>Florida Gov. Ron DeSantis, a Trump ally, signed a law requiring Palm Beach County \u201cto diligently pursue\u201d clearing all requirements to rename Palm Beach International Airport to honor Trump, \u201cincluding by obtaining approval of the Federal Aviation Administration (FAA) and owner of the trademark authorizing its commercial use, and to timely commence signage and branding changes to maintain compliance with state law,\u201d according to the airport\u2019s FAQ page<\/u> on the rebrand.<\/p>\n<\/div>\n

May 5<\/span>The Palm Beach County Commission narrowly approved in a 4-3 vote granting the Trump Organization control of the name \u201cDonald J. Trump International Airport,\u201d and requiring licensed merchandise to be purchased through approved retailers while prohibiting the Trump Organization \u201cfrom receiving royalties, fees, or revenue from the purchase or sale of any such merchandise by county or airport retailers.\u201d<\/p>\n<\/div>\n

The Airport Gets New Name, But Trump Holds Trademark <\/h2>\n

In a highly unusual arrangement, Palm Beach County owns and operates the airport, but Trump holds the trademark. Commercial airports in the United States are virtually all publicly owned and operated by a state or local municipality that controls the trademarked name. Revenue is typically generated through \u201cuser-pays\u201d models, where the airport charges usage fees to airlines (and passed on to customers), as well as through other streams such as parking fees, rental car facility charges, concessions and so on. The airport\u2019s operator \u201centered into an agreement with\u201d the Trump Organization to clarify \u201chow the airport name may be used,\u201d to \u201censure compliance with the state law mandating the name change\u201d and to protect the county from legal claims \u201cincluding claims for trademark infringement and violations of the rights of publicity,\u201d the airport website explains.<\/p>\n

Could Trump Profit From His Airport Licensing Deal?<\/h2>\n

\u201cThe way the license agreement is worded is that the Trump Organization is not allowed to make any money off of goods sold at the airport,\u201d Josh Gerben, founder and managing partner of Gerben IP, a trademark law firm headquartered in Washington, D.C., told Forbes. But that wouldn\u2019t apply to merchandise sold at Trump\u2019s Mar-a-Lago club, less than five miles away. Sales at \u201coff-airport premises would be fair game,\u201d according to Gerben.<\/p>\n

Renaming An Airport For A Sitting President Is Unprecedented<\/h2>\n

More than one quarter of all U.S. presidents have had an airport named after them, but Trump is the first to receive the honor while still in office. John F. Kennedy International Airport (New York City) was renamed after his assassination in 1963. In the late 1990s, airports were renamed after George H.W. Bush (Houston), Ronald Reagan (Washington) and Gerald Ford (Grand Rapids, Michigan). Abraham Lincoln (Springfield, Illinois) and Teddy Roosevelt (Dickinson, North Dakota) didn\u2019t have airports named after them until the early 2000s. \u201cThe Trump airport renaming happened very quickly,\u201d Gerben told Forbes. \u201cFlorida had to pass a law to make it happen and we\u2019re still talking about a matter of months. That\u2019s unusual, and obviously something they wanted to do while [Trump] was still president.\u201d<\/p>\n

Is Palm Beach\u2019s Trump Airport Violating Federal Law By Using Presidential Seal?<\/h2>\n

The new airport logo depicts a bald eagle under an arc of stars holding olive branches in its talons, but it is not an exact replica of the presidential seal. Federal law<\/u> prohibits the use of the presidential seal or a facsimile \u201cfor the purpose of conveying, or in a manner reasonably calculated to convey, a false impression of sponsorship or approval by the government,\u201d with violations punishable by fines and up to six months imprisonment. But \u201cthe statute applies to the use of the seal, not of isolated elements,\u201d Peter M. Shane, a New York University professor and leading scholar in U.S. constitutional and administrative law, told Forbes in an email. \u201cThe logo does not literally violate the legal ban on the unauthorized use of the presidential seal.\u201d<\/p>\n

The Aviation Industry Appears To Expect Blowback From Travelers <\/h2>\n

The airport rebranding is happening against a backdrop of Trump\u2019s low approval ratings<\/u>. Last week, an aviation blog reported that both United Airlines<\/u> and American Airlines<\/u> issued internal staff memos guiding interactions with customers unhappy with the renaming of Palm Beach International. United\u2019s memo appeared to instruct employees to allow passengers ticketed to fly through Trump airport to be rerouted at no charge to alternative airports. \u201cThat internal message was poorly worded and not accurate,\u201d a United Airlines spokesperson told Forbes in an email, clarifying passengers can change a ticket \u201cwithout a fee for many reasons\u201d but not \u201cbecause of an airport\u2019s name or three letter code.\u201d Perhaps most telling is the revamped airport website\u2019s lengthy list of FAQs pertaining to the name change, stressing \u201cthe name change is required by state law\u201d and no property taxes will be allocated since \u201ca state funding appropriation was approved to support the transition.\u201d <\/p>\n
