His wealth is made up of assets<\/u> including his cryptocurrency holdings, real estate investments, licensing deals and his stake in Trump Media and Technology Group, among others. What Is Trump\u2019s Revocable Trust?<\/h2>\n

Trump has not formally divested from the Trump Organization or his other businesses during either of his presidential terms, electing instead to put his assets into a revocable trust that\u2019s meant to take away Trump\u2019s direct control over his finances. The trust is controlled by his son Donald Trump Jr., and the president is the sole donor and beneficiary, meaning he\u2019s the only one who puts assets into the trust or can get money out of it. While the trust puts some daylight between Trump and his finances, it\u2019s still garnered controversy for not being distanced enough from the president, and a regulatory filing last year confirmed<\/u> he \u201chas the right to exercise, or actually exercises, significant influence or control\u201d over the trust. The Trump Organization said in an ethics paper<\/u> after Trump\u2019s reelection that the president\u2019s assets would remain in the trust, and the company appointed an outside ethics advisor to help advise it on any ethical issues regarding the president\u2019s business interests\u2014though it later fired<\/u> that advisor at Trump\u2019s suggestion. The president and the Trump Organization have maintained the president\u2019s business ties are not unlawful, however, with the Trump Organization arguing, \u201cNeither federal law nor the United States Constitution prohibits any President from continuing to own, operate and\/or manage their businesses, investments and others assets while in office.\u201d<\/p>\n

What Information Is The BBC Asking For?<\/h2>\n

The BBC\u2019s asks for a broad swath of financial documents \u201cthat reflect the Trust\u2019s holdings and value,\u201d though Lett\u2019s ruling Monday limits the initial expansive request to only include documents dated between Jan. 1, 2023, and the present. Among the details the subpoena asks for are any documents showing the agreement that created the trust, the total value of the trust, all assets and properties owned by the trust and any tax returns the trust has filed. It asks for an accounting of how the value of the trust has changed each year, which would show if Trump\u2019s businesses lost money as a result of the BBC documentary. The subpoena also asks for information about Trump\u2019s individual businesses and assets within the trust, including details on property deeds, the value of each entity and documents showing the trust\u2019s ownership of each entity. Under the subpoena, the trust must also provide details about any intellectual property held by the trust, as well as \u201ctangible personal property\u201d like \u201cmotor vehicles, jewelry, art, antiques [and] collectibles.\u201d The subpoena identifies hundreds of Trump-linked business entities that are part of the trust and subject to the subpoena, including companies tied to individual Trump properties, crypto company World Liberty Financial, Trump Media & Technology Group, the Trump Organization and companies that handle Trump\u2019s licensing deals.<\/p>\n

Will Trump\u2019s Financial Documents Be Made Public?<\/h2>\n

While Trump\u2019s trust will have to hand over financial documents to the BBC, there\u2019s so far no clear indication on how many of those documents could actually be released publicly, as there\u2019s a protective order in the case that allows materials to remain confidential. That being said, the BBC\u2019s analysis of the documents and whether they actually justify the full amount Trump\u2019s asking for would likely be public, and the public is still likely to gain insights from the documents the trust provides.<\/p>\n

What to Watch for<\/h2>\n

Trump\u2019s lawsuit against the BBC is pending and the court has not yet ruled on the broadcaster\u2019s request to have the litigation thrown out. The BBC argues the case should be dismissed because the documentary footage was not defamatory, and because the BBC does not have a presence in Florida, where Trump filed the lawsuit, that justifies him suing the company there. Trump\u2019s lawyer Alexander Brito has also suggested he wants to limit the scope of the damages in response to the demand for information about Trump\u2019s businesses. A narrower lawsuit would only ask for damages that represent a hit to Trump\u2019s own personal brand and not his business empire\u2014and thus would mean Trump wouldn\u2019t have to turn over information about his businesses\u2019 financials. The BBC has opposed that, arguing Trump\u2019s personal brand is inextricably tied to his business dealings, Politico reports<\/u>. Lett didn\u2019t allow Brito to limit the scope of the lawsuit at a hearing last week, but it\u2019s still possible Trump\u2019s lawyers could try to file a new complaint in order to get out of some of the business disclosure requirements.<\/p>\n

Trump sued<\/u> the BBC in December, alleging it defamed him through how his Jan. 6 speech was edited in the broadcaster\u2019s 2024 \u201cPanorama\u201d documentary. The documentary quotes Trump<\/u> as telling supporters at a rally, \u201cWe’re going to walk down to the Capitol… and I’ll be there with you. And we fight. We fight like hell.\u201d That\u2019s an edited version of the full quote Trump gave at the event, which said, \u201cWe’re going to walk down to the Capitol, and we’re going to cheer on our brave senators and congressmen and women.\u201d Trump then made the comment to \u201cfight like hell\u201d more than 50 minutes later, the BBC notes. Trump\u2019s criticism of the edit led to multiple BBC officials resigning, and the broadcaster apologized<\/u> to the president, acknowledging the edit gave \u201cthe mistaken impression that President Trump had made a direct call for violent action.\u201d The BBC has refused to concede the edit was defamatory, however. Trump\u2019s lawsuit against the BBC is part of a broader series of legal actions the president has taken against media outlets who criticize him, also bringing litigation against such publishers as The New York Times, The Wall Street Journal, CNN, ABC News and CBS News.<\/p>\n
